Contributor Terms and Conditions

In order to submit a contribution to TravelingMamas.com for publication consideration, author agrees to the following publishing agreement:

Blog Contributor Agreement

This Agreement is made between Traveling Mamas, LLC, the official publisher of the Traveling Mamas Blog (the “Publisher”), and submitting author (the “Author”), regarding publication of the Author’s original literary works (the “Works”), via online submission form which heretofore have been, or will be, submitted as a contribution to the Traveling Mamas Blog at http://www.travelingmamas.com (“Blog”).

1. Assignment: In consideration of the Publisher agreeing to publish and distribute Author’s Works, the Author hereby assigns to Publisher all of Author’s right, title and interest in and to the copyrights and all other rights of authorship in the Works so submitted, including without limitation all rights to copy, reproduce, distribute, perform, display and make derivative works based upon, the Works or any part thereof, in any and all media or form of communication whether now existing or hereafter developed, worldwide. “Any and all media” shall include electronic publication by the Publisher on the Publisher’s home page or elsewhere on the Internet, publication in CD-ROM format, or publication in any other medium, whether presently existing or not.  Publisher shall therefore retain the exclusive right to approve reprinting of the Works by others in books, other periodicals, or for other purposes, the right to license or syndicate the Works, or any part thereof, in any and all media as defined above or other form of communication whether now existing or hereafter developed, to others, including but not limited to the right to license to commercial vendors, and the right to use the Works, or any part thereof, in any and all media as defined above that are produced by the Publisher or other entities affiliated with the Publisher, all without any additional approval of the Author.

2. Effective Date:  This Agreement will commence and become effective on the date it is electronically submitted by the Author, but shall apply to all Works previously submitted as described above, as well as to all Works submitted in the future in that manner.  A facsimile copy of this Agreement or any facsimile signature shall be treated as an original.  Publisher’s rights shall include, without limitation, the right not to publish any Work for any reason.

3. Editing of Works: Author agrees to deliver or has delivered to Publisher a complete copy of the Works in manuscript and computer disk format or e-mail or other electronic file transmission or electronic submission via a web site or other file transfer protocol, for electronic editing or typesetting. Author hereby acknowledges and agrees that Publisher shall have the right to edit the Works to conform to Publisher’s standards of style and language usage, grammar, and punctuation, as well as organization and any other editorial standard Publisher deems necessary to maintain the high quality level of the Blog.

4. Warranty and Indemnification: Author represents and warrants that the Works and all figures, illustrations, photographs, tabular, and other supplementary material is original and does not libel anyone or infringe upon any copyright, proprietary right, or any other right whatsoever of any other party or the privacy of others. Author represents and warrants that he/she has full power and authority to enter into this Agreement. Permission shall be obtained by the Author for any excerpts from copyrighted works as may be included in the Works (on a form approved by the Publisher) and shall be submitted with the manuscript or article.  Such permission shall grant Publisher all rights enumerated in Paragraph 1 of this Agreement.

The Author represents and warrants, to the best of Author’s knowledge, that the Works contain no matter that is scandalous, obscene or libelous, or otherwise contrary to the law. Author agrees to indemnify, defend, and hold harmless Publisher and/or its licensees against any and all claims, suits, and/or judgments, including costs, expenses, damages, and legal fees based upon and arising from Author’s violation of the rights of others and/or by reason of a breach of any of the foregoing warranties.

5. No Right of Republication of the Work: Author shall retain no right to reprint, reproduce, adapt or republish any of the Works in any form, including electronic publication on the Internet, without explicit written permission from the Publisher.

6. Execution: Author shall take any and all steps and execute, acknowledge, and deliver any and all further documents necessary to effectuate the terms of this Agreement.

7. Right of Publicity: Publisher shall have the right to use Author’s name, biography, likeness, and signature in connection with advertising, publicity, and promotion of the Works and the Blog. Author may not claim any ownership to the Blog or Servicemark “Traveling Mamas” and shall not represent themselves as an owner or shareholder of the Publisher or the Blog.

8. Binding on Successors and Assigns: This agreement will be binding upon and inure to the benefit of the heirs, executors, administrators, legal representatives, successors, and assigns of the parties.

9. Entire Agreement: This Agreement constitutes the whole Agreement between Author and Publisher and may not be modified except by written Agreement of both parties.

            If the foregoing accurately sets forth Author’s understanding of this Agreement and is acceptable, indicate approval by checking the box to submit said content. By submitting content electronically via online form, author agrees to these terms, which are binding.

Author agrees to disclose any personal or financial relationship to any company or product mentioned in submissions, in compliance with FTC guidelines.

Author must be at least 21 years of age. This agreement shall be binding in the US and the country of the Author’s residency, if outside the US.
